FEES

Mr. Pomerance charges $9,500 for a full day mediation and $6,000 for a half day mediation. This includes up to three hours of preparation time (which includes reviewing of briefs, pre-mediation phone calls, etc.), up to eight hours of mediation time, and administration costs. Fees for additional time will be charged at $875 per hour. Fees for “unused” time will not be refunded. Mr. Pomerance reserves the right to charge additional fees for cases involving multiple separately represented parties and particularly complex issues.

Please do not reserve a mediation date unless you are sure that you will go forward. Counsel, not their clients, contract for the
mediator’s services and are responsible for paying all fees.

Things To consider

Mediation fees are due in full upon booking and must be received no later than 30 days before mediation. We reserve the right to take matters off calendar if fees are not paid timely.

Fees include a non-refundable administrative fee of $500 per separately represented party. In the event of cancellation or continuance, this fee will not be refunded.

Cancellations or continuances 30 days or less prior to mediation will result in forfeiture of the entire mediation fee, unless we can fill the date with another matter.

Mediation Briefs

Mediation briefs are highly encouraged. Please try to put some real thought and effort into what you want and need to say, and to limit your brief to 15 pages. (Remember the old sayings “Brevity is the soul of wit”, or “I have only made this brief long because I haven’t had the time to make it shorter”). However, if you feel it is really helpful to include some relevant documents or exhibits with your brief in order to fully explain your position, that is certainly acceptable.

Please do your best to submit your brief at least 3 business days prior to the mediation, and send them to Nikki Safavi (see contact information, below).

Book your mediation

Mr. Pomerance is available for mediation via video conference or in person in the greater Los Angeles area. In-person mediations take place at a location provided by counsel, which must include adequate conference room space for all parties and the mediator. Please contact us with any questions or concerns.
